In an effort to improve HOA transparency and accountability, a new law went into effect October 1, 2023 in Florida. The new law establishes an HOA Bill of Rights, allows for the removal of officers and directors, and prevents fines from becoming a lien against homeowners. The new law also includes provisions under which board members and officers may be removed and/or fined for accepting kickbacks and includes criminal penalties for fraudulent voting activities.
