Its a common question. Without a simple answer. How your assets are titled can make a drastic difference in how they are disbursed at your death. Whether your bank account, credit cards, and even real property are titled as tenancies by the entirety, tenants in common with joints rights of survivorship, or tenants in common will determine whether or not they need to be probated. Additionally, each offer differing protections to spouses and heirs, and also from creditors. In Florida, unlike some other states, rights of survivorship are not automatic.
