Newly Enacted Florida Trust Laws
Selecting a Trustee for your Trust is an important consideration. Trustees are fiduciaries and as such are required to adhere to both State and Federal guidelines regarding investments and management of the Trust. Florida has recently enacted the Florida Uniform Directed Trust Act (“FUDTA”) and the Community Property Trust Act (“CPTA”), effective as of July 1, 2021. Consult your attorney for additional information regarding how this impacts your estate planning documents.
