One power a trustee may have is to buy, sell, lease or convey trust property. As such, trustees are often parties in real estate transactions. Having an attorney represent you in a real estate transaction is always wise. Buying and selling as a trustee, or to or from a trust, will involve additional considerations pertaining to homestead, mortgage and title requirements. You may need a Certification of Trust, Affidavits, Quitclaim Deeds or other documents that require drafting by an experienced attorney licensed in the state where the property is located.
