Each state has its own rules and requirements for probate proceedings. Probate is filed in the state in which you reside. In Florida, if your estate contains more than a total of $75,000, your attorney and personal representative will need to file formal administrative proceedings, regardless of whether or not you have a will. If you own property in states other than Florida, you may also need to file ancillary probate in those other states. There are measures you can take to streamline this process.
